Terms of Service

These terms cover your use of JobSiteMap. They are written to be read: if something here is unclear, ask us.
The agreement
These terms are an agreement between you and JobSiteMap (“we”, “us”), the operator of the JobSiteMap web app and mobile app (the “service”). By creating an account or using the service you accept them. If you use the service on behalf of a company or other organisation, you accept them for that organisation and confirm you are allowed to.
Our Privacy Policy explains how we handle personal information, and forms part of these terms.
The service
JobSiteMap lets an organisation record where its physical equipment is on job sites, on a satellite map, and how long each unit has been there. It includes sites and boundaries, equipment records with fields and statuses the organisation defines, photographs, delivery runs, change history with undo, and an audit trail of who did and viewed what.
Map imagery and address search come from third parties. They are a guide, not a survey: imagery can be out of date and an address can resolve to the wrong place. Check anything that matters on the ground.
Accounts and organisations
- The service is organised around organisations. Whoever creates an organisation becomes its owner. The owner and the administrators they appoint invite members, give them roles, and decide which sites they can see.
- Members act under the roles their organisation gives them. What you can see and change is set by your organisation, and some changes you make may need approval from someone else in it.
- Give accurate details, keep your sign-in credentials to yourself, and tell us at support@jobsitemap.com if you think someone else has used your account. Each new device must be approved before it can sign in; you are responsible for what is done from devices you approve.
- You must be at least 16, and old enough to enter a contract where you live.
Acceptable use
Do not use the service to:
- break the law, or infringe anyone else’s rights, including their privacy;
- upload anything unlawful, harmful, or that you have no right to share;
- access data or accounts that are not yours, probe or test the service’s security without our written permission, or get around its limits, approvals or access controls;
- overload or disrupt the service, scrape it, or use automated means to access it other than through the interfaces we provide;
- copy, resell or build a competing product from the service or its map and address data.
We may suspend access that breaks these rules or puts the service or other customers at risk. Where we can, we will tell you first and give you a chance to fix it.
Your data
Your organisation owns its data: its sites, equipment records, photographs, configuration and history. We claim no ownership of it.
You give us permission to store, copy, process and display that data only as needed to provide, secure and support the service for you, and as described in the Privacy Policy. We do not sell it and we do not use it for advertising.
You are responsible for the data your organisation puts into the service, and for having the right to put it there, including photographs and any personal information about other people.
If you send us feedback or suggestions, we may use them to improve the service without owing you anything for it.
Availability and changes
We work to keep the service running and your data safe, but we do not promise it will be available without interruption or free of errors, except where a separate written agreement with your organisation says otherwise. We may need to take it down for maintenance, and things outside our control can affect it.
The service will change over time. We may add, change or remove features. If we remove something your organisation relies on, we will give reasonable notice where we can.
Fees
The service is free to use during its current trial period. When paid plans launch, they will be offered at the prices and with the limits shown at the time, and processed by Stripe. Nothing will be charged without your organisation choosing a paid plan first. Unless the law says otherwise, fees already paid are not refundable.
Ending the agreement
- Your organisation can stop using the service and ask us to close its account at any time by emailing support@jobsitemap.com.
- We may suspend or close an account that seriously or repeatedly breaks these terms, or if the law requires it. We may also end the service as a whole with reasonable notice.
- Before an account closes, its owner can ask us for a copy of the organisation’s data, and we will provide it in a usable format. After closing, we delete or anonymise the data as the Privacy Policy describes.
The sections on your data, disclaimers, limitation of liability and general terms continue to apply after the agreement ends.
Disclaimers
To the extent the law allows, the service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that map imagery, addresses, measurements or any other information in the service is accurate or complete.
Limitation of liability
To the extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for lost profits, revenue, data or business opportunity, arising from your use of the service, even if we were told it was possible.
Our total liability for any claim relating to the service is limited to the greater of the amount your organisation paid us in the twelve months before the claim arose, or one hundred US dollars.
Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud or for death or personal injury caused by negligence.
General
- We may update these terms. We will change the date at the top, and tell account owners before a significant change takes effect. Continuing to use the service after that means you accept the new terms.
- These terms are governed by the laws of the place where the operator of JobSiteMap has its principal place of business.
- If part of these terms cannot be enforced, the rest still applies. Not enforcing a term straight away does not mean we have given it up.
- You may not transfer these terms without our agreement. We may transfer them to a successor that takes over the service.
- These terms, with the Privacy Policy and any separate written agreement with your organisation, are the whole agreement about the service.
